ZoningVerdict

How long do I have to appeal a zoning decision in Rochester Hills?

You have 21 days. Appeals of administrative zoning decisions in Rochester Hills must be filed with the Planning and Development Department within 21 days of the decision (§ 138-2.404). The Zoning Board of Appeals hears the appeal.

Filing has an immediate effect: the appeal stays the proceedings, except where there is imminent peril (§ 138-2.404).

One carve-out matters. The ZBA cannot hear appeals of City Council conditional-use decisions (§ 138-2.301.F). Those follow a different path.

The 21-day clock is short. If you are weighing an appeal, contact Planning and Economic Development promptly at 248-656-4660 to confirm filing requirements and the next hearing date.
