ZoningVerdict

What uses are allowed in NB versus HB zoning in Rochester Hills?

NB is neighborhood business and HB is highway business (§ 138-4.100, Table 3). Both allow consumer-facing commerce; HB allows more intensive uses.

Permitted in both: retail under 75,000 square feet, restaurants, personal services, banks, and offices. NB also allows places of assembly under 5,000 square feet. Business district uses must deal directly with consumers, with activity inside enclosed buildings (§ 138-4.300, Table 4; § 138-4.301.B).

Key differences:

  • Gas stations are conditional in NB but permitted in HB (§ 138-4.404).
  • Car washes are allowed only in HB, as a conditional use, and retail over 75,000 square feet is conditional in HB (§ 138-4.300, Table 4).
  • Hotels are conditional in HB (§ 138-4.415).
  • Drive-throughs are conditional in all business districts (§ 138-4.407).
  • HB allows 3 stories and 42 feet, against 2 stories and 30 feet in NB (§ 138-5.100, Table 7).
